STKS 'Rule the Backyard' Trade Promotion — Terms and Conditions

Bollé Safety AU Pty Limited ACN 005 741 300 (Promoter) is administering the STKS 'Rule the Backyard' trade promotion (Promotion).

1. Definitions

Eligible Entrants are persons who are eligible to submit an entry to the Promotion pursuant to clause 2.

Eligible STKS Product means all Bollé Safety glasses within the STKS range.

Immediate Family means a spouse, de facto spouse, parent (including a spouse or de facto spouse of a parent), natural or adopted child, sibling (whether natural or adopted by parent or a spouse or de facto spouse of a parent), grandparent, grandchild, aunt, uncle, niece, nephew or first cousin.

Participating Bollé Safety Retailer means an existing Bollé Safety retailer in Australia or New Zealand participating in the STKS retail activation campaign.

2. How to Enter

1. Entry into the Promotion is free and open to Australian and New Zealand residents aged 18 years and over. All entrants must be individuals.
2. Employees, management and directors of:
   1. the Promoter;
   2. Participating Bollé Safety Retailers; and
   3. any agencies, distributors or entities involved in conducting the Promotion;
   are ineligible to enter.
3. The Immediate Family of any persons listed in clause 2(b)(i)–(iii) are ineligible to enter.
4. Information on how to enter and details of prizes form part of these Terms and Conditions. Entry into the Promotion constitutes acceptance of these Terms and Conditions and the formation of a contract with the Promoter.
5. The Promotion begins on 15 September 2026 and ends on 30 November 2026 (Promotion Period).
6. To enter the Promotion, entrants must:
   1. purchase an Eligible STKS Product from a Participating Bollé Safety Retailer during the Promotion Period;
   2. complete the entry form available by scanning the QR code displayed on relevant promotional material or on the campaign landing page available via bolle-safety.com/rule-the-backyard, and providing the requested proof of the purchase of the Eligible STKS Product.
7. Failure to provide satisfactory proof of purchase or other information reasonably required by the Promoter to verify eligibility may result in disqualification. Entrants must retain their original proof of purchase of the Eligible STKS Product.
8. Entries are limited to 1 entry per transaction involving the purchase of Eligible STKS Products, per person.
9. Entries may only be submitted in accordance with these Terms and Conditions.
10. Entries must be received by the Promoter during the Promotion Period and no later than midnight on 30 November 2026. Any entry received by the Promoter outside of the Promotion Period will not be accepted. The Promoter does not accept any responsibility for late or misdirected entries.
11. If a purchase that gave rise to an entry is cancelled or refunded, the associated entries to the Promotion may be withdrawn from the Promotion.

3. Additional Entries via Instagram

1. Eligible Entrants may receive 5 additional entries into the Promotion if they:
   1. provide their Instagram handle in the entry form;
   2. publish a photograph clearly featuring an Eligible STKS Product on their public Instagram account;
   3. only publish a photograph that is not making any statement, inference or representation that is, in the opinion of the Promoter, misleading, untrue, scandalous, inflammatory, racist, sexist, homophobic, pornographic or in any other way objectionable or derogatory;
   4. tag @bolle_safety;
   5. keep the post publicly visible until at least the end of the Promotion Period; and
   6. comply with any additional requirements specified by the Promoter.
2. The additional entries will be awarded if the Promoter is reasonably satisfied that the entrant has complied with the requirements of this clause.
3. The Instagram component of the Promotion does not alter the chance-based nature of the Promotion.
4. By participating in the Instagram component of the Promotion, entrants grant the Promoter a non-exclusive, perpetual, royalty-free licence to reproduce, publish, repost and otherwise use content uploaded or published in connection with the Promotion for promotional and marketing purposes.

4. Details of the Draw

1. This is a game of chance. Prize winners will be chosen by way of a random draw conducted by an electronic random number generator at 3:00pm on 3 December 2026 at 32-40 Fairchild St, Heatherton VIC 3202.
2. Following the draw, winners will be contacted by email within 48 hours and may be required to confirm their identity and eligibility to the Promoter's satisfaction before a prize is awarded.
3. If a winner fails to provide satisfactory proof of identity or proof of purchase, is otherwise ineligible, cannot be contacted, or does not claim their prize within 14 days of notification, the Promoter will conduct a redraw to determine a replacement winner. Any redraw will occur at the same location as the original draw at 12:00pm on 21 December 2026, and the replacement winner will be notified in the same manner as the original winner.
4. Within 30 days of the draw, the surname, first initial and postcode of each winner will be announced by publication on the Promoter's website at bolle-safety.com/rule-the-backyard. The publication will be available for at least 28 days from the date of publication.

5. Prizes

1. The following prizes will be awarded in the Promotion:
   1. 5 major prize winners, which will be drawn first, will each receive:
      1. 1 JBL PartyBox 130 Speaker (current RRP AUD $599 / NZD $599.99); and
      2. 1 Ninja Woodfire Electric BBQ Grill & Smoker (current RRP AUD $694 / NZD $599.99),
      with a total approximate retail value of AUD $1,293 / NZD $1,199.98 per major prize.
   2. 10 runner-up prize winners will each receive 1 digital Visa gift card delivered electronically with a face value of AUD $100 / NZD $100.
2. The total approximate retail value of all prizes available to be won in the Promotion is AUD $7,465 / NZD $6,999.90.
3. Prizes will be delivered to the winners at no cost within a reasonable period (being not longer than 28 days) following verification of eligibility and receipt of delivery details.
4. The prizes are not transferable, exchangeable or redeemable for cash, except at the Promoter's discretion.
5. If a prize becomes unavailable for reasons beyond the Promoter's reasonable control, the Promoter reserves the right to substitute the prize with a prize of equal or greater value.
6. The Promoter accepts no responsibility for any variation in the value of a prize between the date of publication of these Terms and Conditions and the date on which the prize is awarded.
7. Any ancillary costs associated with claiming or using a prize are the responsibility of the relevant winner, unless expressly stated otherwise in these Terms and Conditions.

6. Privacy

1. The Promoter may collect personal information about entrants for the purposes of administering this Promotion, and for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrants. For these purposes, or if required by law, the Promoter may disclose such information to third parties, including (without limitation) agents, contractors, service providers and regulatory authorities. Entry is conditional upon the Promoter being able to use the entrant's information as set out in these Terms and Conditions. The Promoter's Privacy Policy is available at bolle-safety.com/au/privacypolicy.html. Participants can direct any request to opt out, access, update, or correct information to the Promoter at rgpd@bollebrands.com.
2. By participating in the Promotion, you agree to the Promoter's collection and use of your personal information and acknowledge that you have read and accepted the Privacy Policy.
3. To the extent permitted at law, by entering the Promotion, each winner consents to the Promoter publishing their name, postcode and, where provided, photographs, statements, social media handle and content submitted in connection with the Promotion for promotional, marketing and publicity purposes relating to the Promotion and the Promoter's products.

7. Limitations of Liability

1. Without limiting clause 7(b), to the maximum extent permitted by law, the Promoter (including its respective officers, employees and agents) is not responsible for any loss, damage or expense arising from participation in the Promotion or acceptance of a prize.
2. Nothing in these Terms and Conditions excludes, restricts or modifies, or purports to exclude, restrict or modify, any statutory consumer guarantee, implied warranties or other right available to:
   1. an Australian entrant, under the Australian Consumer Law contained in the Competition and Consumer Act 2010 (Cth); or
   2. a New Zealand entrant under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or Part 3 of the Contract and Commercial Law Act 2017,
   that cannot lawfully be excluded.

8. Social Media

This Promotion is in no way sponsored, endorsed, administered by or associated with Meta (including Facebook and Instagram), LinkedIn or any other social media platform through which it may be promoted. Entrants release those platforms from any and all liability associated with the Promotion.

9. Compliance with New Zealand and Australian Laws

1. This Promotion is a sales promotion scheme conducted in connection with the purchase of an Eligible STKS Product, and is authorised in New Zealand under section 18 of the Gambling Act 2003.
2. The Promoter is required to comply with New Zealand and Australian laws. In the unusual circumstance that providing a prize to an entrant may, in the Promoter's opinion (which will be final), place the Promoter in breach of New Zealand or Australian law, then:
   1. the Promoter will not be liable to provide the prize (or its value, in cash or otherwise) to the entrant;
   2. the Promoter will not be obliged to refund the purchase price of the Eligible STKS Product purchased by the entrant; and
   3. the Promoter will, unless restricted by law from doing so, disclose its reasons for refusing to provide the prize to the entrant.

10. Force Majeure

1. Subject to any necessary approval by an Australian State or Territory authority (as applicable) the Promoter may cancel, modify, suspend or postpone the Promotion where circumstances beyond its reasonable control prevent or hinder the Promotion from being conducted as originally contemplated.
2. The Promoter will not be liable for any loss or damage suffered by an entrant arising from any such cancellation, modification, suspension or postponement.
3. The Promoter is not responsible for technical malfunctions, computer errors, network failures or other technical issues that may affect participation in the Promotion or the conduct of the draw.

11. Disputes / Governing Law

These Terms and Conditions and the Promotion shall be governed by and must be construed in accordance with the laws of the entrant's resident State or Territory in respect of Australian entrants, and the laws of New Zealand in respect of New Zealand entrants. All Australian entrants submit to the non-exclusive jurisdiction of the courts of Victoria, Australia. All New Zealand entrants submit to the non-exclusive jurisdiction of the courts of New Zealand.

12. Severability

If any provision of these Terms and Conditions is held to be invalid, illegal, or unenforceable, such provision shall be severed, and the remaining provisions shall not be affected or impaired.

13. Authority

The Promotion is operated under:

1. in South Australia, licence no. T26/1588; and
2. in the Australian Capital Territory, permit no. TP 26/02096.
